Commercial Space Activity Advisory Committee Act

PURPOSE AND POLICY FRAMEWORK

Commercial space is no longer emerging—it is critical infrastructure, and infrastructure demands public accountability. As commercialization scales, consumer exposure scales with it.

These amendments ensure that as commercial space governance develops, it reflects a balanced public-interest framework—not solely industry participation. They introduce targeted, non-burdensome safeguards to strengthen transparency, accountability, and consumer protection without expanding regulatory authority.

SECTION 1. SHORT TITLE.

This Act may be cited as the “Commercial Space Consumer Safeguards Amendment Act.”

SECTION 2. CONSUMER REPRESENTATION REQUIREMENTS.

(a) IN GENERAL.

Section ___ of S. 434 is amended by inserting after subsection (Membership) the following:

(1) Not fewer than three members of the Advisory Committee shall represent consumer or public-interest perspectives.

(2) Such members shall possess demonstrated expertise in at least one of the following:

(3) No individual shall be appointed as a consumer representative if such individual has been employed by, or registered as a lobbyist for, a commercial space entity within the preceding 3 years.

(b) BALANCE REQUIREMENT.

The Secretary shall ensure that the Advisory Committee’s membership reflects a balanced representation of commercial, academic, technical, and public-interest perspectives.

SECTION 3. ANNUAL COMMERCIAL SPACE CONSUMER RISK REPORT.

(a) REPORT REQUIRED.

The Advisory Committee shall submit to the Secretary of Commerce and make publicly available an annual report titled the “Commercial Space Consumer Risk Assessment.”

(b) CONTENTS.

The report shall include:

  1. An assessment of safety risks to private participants in commercial human spaceflight;
  2. An evaluation of infrastructure vulnerabilities associated with commercial satellite operations;
  3. A review of liability frameworks and insurance sufficiency for consumer protection;
  4. An analysis of market concentration and potential consumer pricing impacts;
  5. Identification of systemic risks affecting emergency communications, aviation, financial timing systems, and broadband access.

(c) PUBLIC AVAILABILITY.

The report shall be published on a publicly accessible website not later than 30 days after submission.

SECTION 4. TRANSPARENCY AND PUBLIC ACCOUNTABILITY.

(a) PUBLIC MEETINGS.

All non-classified meetings of the Advisory Committee shall be webcast and archived for public viewing.

(b) PUBLICATION OF MATERIALS.

The Committee shall publish:

Members shall file public financial disclosure statements consistent with applicable federal advisory committee requirements.

SECTION 5. REQUIRED SECRETARIAL RESPONSE.

Not later than 180 days after receipt of any formal recommendation of the Advisory Committee, the Secretary of Commerce shall:

  1. Issue a written public response addressing each recommendation; and
  2. Provide justification for any recommendation not adopted.

SECTION 6. LIABILITY AND COMPENSATION REVIEW.

(a) STUDY REQUIRED.

The Advisory Committee shall conduct a comprehensive review of:

  1. Cross-waiver and indemnification provisions in commercial space launch and operations agreements;
  2. Existing mechanisms for compensating consumers in the event of commercial space-related failures;
  3. Insurance adequacy for private human spaceflight participants.

(b) RECOMMENDATIONS.

Not later than two years after enactment, the Committee shall submit recommendations to Congress regarding improvements to consumer compensation frameworks.

SECTION 7. NON-PREEMPTION OF EXISTING CONSUMER PROTECTION AUTHORITY.

Nothing in this Act shall be construed to:

  1. Preempt or limit the authority of the Federal Trade Commission;
  2. Preempt or limit the authority of the Consumer Financial Protection Bureau;
  3. Preempt or limit state consumer protection laws;
  4. Weaken existing safety, disclosure, or liability standards.

SECTION 8. MARKET CONCENTRATION REVIEW.

The Advisory Committee shall include within its annual report:

  1. An assessment of market concentration in launch services, satellite broadband, and related commercial space sectors;
  2. Analysis of potential impacts on consumer pricing, service access, and competition;
  3. Recommendations for preserving competitive market conditions.
